1. Scope
This policy forms part of our Terms of service. It applies to every Shop we run, to the products and content in it, and to the way merchants and their staff use our service. Capitalised terms have the meaning given in the Terms.
Stripe applies its own rules to the businesses that use its services, set out in its list of restricted and prohibited businesses. Your Shop must comply with both this policy and Stripe's rules. Where they differ, the stricter rule applies.
2. Prohibited products and activities
You may not use your Shop to sell, offer or promote:
- Illegal goods and services, or anything you are not allowed to sell in the country where you or your Customers are, including stolen goods and products subject to sanctions or export restrictions.
- Weapons: firearms, ammunition, explosives, weapon parts and accessories, replicas that could be mistaken for real weapons, and knives or other blades whose sale is prohibited or restricted by law.
- Drugs: illegal drugs and psychoactive substances, “legal highs”, drug paraphernalia, and medicines, including prescription-only medicines.
- Tobacco and nicotine products: cigarettes, cigars, tobacco, e-cigarettes, e-liquids, heated tobacco and nicotine pouches.
- Cannabis, and CBD products wherever their sale or marketing is restricted or prohibited, or where Stripe does not accept them.
- Alcohol without an age check: alcohol sold without asking Customers to confirm their age, or sold or delivered to minors.
- Counterfeit or infringing goods: fakes and replicas of branded products, and products or content that infringe someone else's trade marks, copyright or other rights, including photos you do not have the right to use.
- Adult content and services, including pornography and sexual services.
- Gambling: games of chance, betting, lotteries and paid-entry raffles.
- Financial services and crypto-assets: loans and credit, investments, currency exchange, money transfer, crypto-assets and tokens, and prepaid cards or vouchers that can be used with other businesses. Gift vouchers for your own products and services are allowed.
- Hazardous goods: fireworks and pyrotechnics, flammable, toxic, corrosive or radioactive substances, and any goods that the law or your carrier does not allow you to ship.
- Unsafe or recalled products, and products that do not meet the safety rules that apply to them.
- Protected species and products made from them in breach of the law.
- Anything on Stripe's list of prohibited businesses, and anything on its list of restricted businesses unless Stripe has approved it for your account.
- Deceptive or unfair practices, such as pyramid schemes, fake discounts or misleading claims.
3. Products allowed under conditions
The following products may be sold only if the law allows it wherever you sell them, if Stripe accepts them and, where indicated, with our prior written agreement:
- Alcoholic drinks: with any licence required, an age confirmation at checkout, age checks on collection or delivery where the law requires them, and compliance with the rules on alcohol advertising, such as the Loi Évin in France.
- Kitchen, craft and collectors' knives whose sale is lawful: with the age checks and delivery restrictions required by law, such as the rules on the sale and delivery of bladed articles in the United Kingdom.
- Food supplements, and foods carrying nutrition or health claims: only with the information and authorisations required by law.
- Live animals: only with our prior written agreement, and in compliance with the rules on animal welfare, health and transport.
4. Content rules
The content of your Shop — product names, descriptions, photos, prices and other texts — must:
- be accurate and not misleading, including about prices, origin, composition, quality labels and protected designations (such as AOP, AOC or organic labels, which may only be used if you are entitled to them);
- not include fake reviews, ratings or endorsements;
- not be hateful, discriminatory, violent, harassing or defamatory, or infringe anyone's privacy;
- not contain malicious code or links to fraudulent websites;
- comply with the specific rules that apply to your products, such as food information, allergens and alcohol advertising.
Order emails and Customer data may be used only for the Orders concerned and as allowed by data protection law. Do not use them to send marketing messages that the law does not allow.
5. Security
- Do not try to access data, accounts or systems that you are not authorised to access, including other merchants' Shops.
- Do not test, scan or probe the security of our systems, or overload them, without our written permission. If you find a vulnerability, report it to security@addyour.shop and do not exploit it.
- Do not interfere with the operation of the Service, for example by automated mass requests or attempts to bypass its limits.
- Keep your login details confidential and tell us immediately if you suspect they have been compromised.
6. Reporting illegal content
Anyone can tell us about content in a Shop we run that they believe is illegal or breaks this policy, in accordance with article 16 of the Digital Services Act (Regulation (EU) 2022/2065). Write to legal@addyour.shop (or by post, to the address in our Legal notice) and include:
- an explanation of why you consider the content illegal;
- the exact location of the content, such as the URL of the page or product;
- your name and email address (except for reports of child sexual abuse material, which can be made anonymously);
- a statement confirming that you believe in good faith that the information and allegations in your report are accurate and complete.
We confirm receipt and handle every report in a timely, diligent, non-arbitrary and objective manner. Reports are reviewed by a person; we do not use automated decision-making. We tell you our decision and how you can challenge it. If we act on the content, we give the merchant a statement of reasons. If we become aware of information suggesting a criminal offence involving a threat to the life or safety of people, we inform the competent authorities.
Intellectual property complaints can be sent to the same address. If you are a Customer with a question about an order, please contact the merchant directly.
7. Enforcement
If a product, content or activity breaks this policy or the law, we may, depending on the seriousness of the situation: ask you to correct it; hide or remove the content or product concerned; pause checkout; suspend the Service; or end the contract, as provided in the Terms. Our response is proportionate, and we take into account whether the breach is deliberate, serious or repeated.
Unless the law or urgency prevents it, we tell you before acting, and in any case we give you a statement of reasons: the measure and its duration, the facts and the rules concerned, whether the measure follows a report or our own checks, and how you can challenge it. You can contest our decision by replying to our email; a member of our team will review it. You can also go to court. Stripe may also take measures on your Stripe account under its own rules.
8. Changes
We may update this policy in accordance with the Terms, with at least 30 days' notice by email, unless a change is required by law or to address an imminent danger. The policy is drafted in English and a French version is provided; if the two versions differ, the English version prevails, and clause 1.4 of the Terms applies.
